Background This study introduces an empirical approach for studying the role of prudence in physician treatment of end-of-life (EOL) decision making.Methods A mixed-methods analysis of transcripts from 88 simulated patient encounters in a multicenter study on EOL decision making. Physicians in internal medicine, emergency medicine, and critical care medicine were asked to evaluate a decompensating, end-stage cancer patient. Transcripts of the encounters were coded for actor, action, and content to capture the concept of Aristotelian prudence, and then quantitatively and qualitatively (...) analyzed to identify actions associated with preference-concordant treatment.Results Focusing on codes that describe characteristics of physician-patient interaction, the code for physicians restating patient preferences was associated with avoiding intubation. Multiple codes were associated with secondary measures of preference-concordant treatment.Conclusions Prudent actions can be identified empirically, and research focused on the virtue of prudence may provide a new avenue for assessment and training in EOL care. The question 'Why should I obey the law?' introduces a contemporary puzzle that is as old as philosophy itself. The puzzle is especially troublesome if we think of cases in which breaking the law is not otherwise wrongful, and in which the chances of getting caught are negligible. Philosophers from Socrates to H.L.A. Hart have struggled to give reasoned support to the idea that we do have a general moral duty to obey the law but, more recently, the greater number (...) of learned voices has expressed doubt that there is any such duty, at least as traditionally conceived. Tacit consent theories of political obligation have fallen into disfavor. The difficulties that plague such accounts have been well-known since Hume's "Of the Original Contract"1 and have recently been forcefully reformulated by M. B. E. Smith, A. John Simmons, and Joseph Raz.2 In this article, though, I shall argue that Hobbes' version of the argument from tacit consent escapes the criticisms leveled by Hume, Smith, Simmons, and Raz against tacit consent theories as a class. Crucial to my defense of (...) this claim will be a certain interpretation of Hobbes' account of covenants, an account quite different than that presupposed by the opponents of the argument from tacit consent. Over the past 50 years, academic-industrial collaborations and technology transfer have played an increasingly prominent role in the biomedical sciences. These relationships can speed the delivery of innovative drugs and medical technologies to clinical practice, creating important public health benefits as well as income for universities and their faculty. At the same time, they raise ethical concerns, particularly when research involves human subjects in clinical trials. Lapses in oversight of industry sponsored clinical trials at universities, and especially patient deaths in (...) a number of trials, have brought these issues into the public spotlight and have led the federal government to intensify its oversight of clinical research. The leadership of Harvard Medical School convened a group of leaders in academic medicine to formulate guidelines on individual financial conflicts of interest. They and other groups are working to formulate a national consensus on this issue. (shrink)

Experimenters sometimes insist that it is unwise to examine data before determining how to analyze them, as it creates the potential for biased results. I explore the rationale behind this methodological guideline from the standpoint of an error statistical theory of evidence, and I discuss a method of evaluating evidence in some contexts when this predesignation rule has been violated. I illustrate the problem of potential bias, and the method by which it may be addressed, with an example from the (...) search for the top quark. A point in favor of the error statistical theory is its ability, demonstrated here, to explicate such methodological problems and suggest solutions, within the framework of an objective theory of evidence. Ancient Greek philosophical schools are said to share a common structure in their ethical theories which is characterized by a eudaimonistic teleology based in an understanding of human nature. At first glance, the skepticism of Sextus Empiricus as described in the Outlines of Pyrrhonism seems to fit into this model insofar as he describes the end of the skeptic as ataraxia, a common account of the expression of human happiness. I argue that this is a misunderstanding of Sextus’s philosophy for (...) several reasons. “The end of skepticism” cannot be eudaimonistic or teleological in the way that other ancient ethical theories are typically understood; moreover, ataraxia is not an end derived from a theory about human nature. For these reasons, the skeptical way of life is radically different than the ethical theories proposed by other schools. I argue that this difference is a result of the character of the skeptical enterprise which involves the implicit rejection of norms in both the epistemological and the ethical spheres. (shrink)

It uses philosophical theory to show why medical doctors may be involved at different stages of the capital punishment process. The author uses the theories of Emmanuel Kant and John S. Mill, combined with Gerwith's principle of generic consistency, to concretize ethics in capital punishment practice. For almost a decade, I have taught an undergraduate course on death and dying and have served as an ethics consultant in an academic medical center where I support patients and families navigating difficult end-of-life decisions. Chapters from Elisabeth Kübler-Ross's On Death and Dying, Sherwin Nuland's How We Die, and Atul Gawande's Being Mortal are required reading in my course because these physician-writers offer detailed, firsthand stories that help readers imagine the places and faces of dying patients and their families. The standard “gladiatorial” interpretation of the Modes of Agrippa has undergone several recent attacks. Scholars have criticized it because it seems to portray the skeptic as a dogmatist about logical support and because it does not treat all five Modes as part of the system. Although some have attempted to patch up the standard interpretation to address these issues, I raise a further problem: The gladiatorial interpretation cannot make sense of the skeptic using the Modes on herself, to suspend her (...) own judgment. In light of these problems, I propose a fresh interpretation: The Agrippan Modes should be understood, not as arguments (or argument forms), but as types of dialectical challenge that the skeptic can use in an endless inquiry into any dogmatic position. This book provides an elaboration and evaluation of the dominant conceptions of genetic counseling as they are accounted for in three different models: the teaching model; the psychotherapeutic model; and the responsibility model. The elaboration of these models involves an identification of the larger traditions, visions and theories of communication that underwrite them; the evaluation entails an assessment of each model’s theses and ultimately a comparison of their adequacy in response to two important concerns in genetic counseling: the contested values (...) of non-directiveness and the recognition of differences across perspectives, with special focus on how religious and spiritual beliefs of patients are coordinated with the networks of meaning in genetics. Several insights are made explicit in this project through the work of Robert Brandom. Brandom’s deontic scorekeeping model demonstrates how dialogue is at the root of grasping a conceptual content. Against this backdrop, professional communications such as genetic counseling can be seen as late developments in linguistic practices that have structural challenges. Brandom’s model reminds us that the professional needs the client’s understanding to grasp conceptual content in a particular context. (shrink)

Multifunctionality poses significant challenges for human brain mapping. Cathy Price and Karl Friston argue that brain regions perform many functions in one sense and a single function in another. Thus, neuroscientists must revise their “cognitive ontologies” to obtain systematic mappings. Colin Klein draws a different lesson from these findings: neuroscientists should abandon systematic mappings for context-sensitive ones. I claim that neither account succeeds as a general treatment of multifunctionality. I argue that brain areas, like genes or organs, are multifunctional in (...) different ways. I call this the “functional heterogeneity hypothesis.” I contend that different multifunctional parts require different mapping strategies. (shrink)

Functional localization is a central aim of cognitive neuroscience. But the nature and extent of functional localization in the human brain have been subjects of fierce theoretical debate since the 19th Century. In this essay, I first examine how concepts of functional localization have changed over time. I then analyze contemporary challenges to functional localization drawing from research on neural reuse, neural degeneracy, and the context-dependence of neural functions. I explore the consequences of these challenges for topics in philosophy of (...) science and philosophy of mind including localizationist versus anti-localizationist approaches to cognitive neuroscience, multiple realizability, reverse inference in functional neuroimaging, and the modularity of mind. Pyrrhonian skeptics, according to Sextus Empiricus, suspend judgment in the face of equally strong oppositions, but they also continue to investigate. This joint characterization has puzzled scholars: Why keep investigating if the evidence demands epochē? On this point, Sextus has been accused of muddled thinking at best and incoherence at worst. In this paper, I explain how investigative activity harmonizes with the suspensive mindset. My interpretation helps to explain several puzzling features of Pyrrhonian philosophy in addition to the idea that (...) one can both suspend judgment and continue investigating. (shrink)

According to Mark Rubinstein ‘In 1952, anticipating Kenneth Arrow and John Pratt by over a decade, he [de Finetti] formulated the notion of absolute risk aversion, used it in connection with risk premia for small bets, and discussed the special case of constant absolute risk aversion.’ The purpose of this note is to ascertain the extent to which this is true, and at the same time, to correct certain minor errors that appear in de Finetti's work.
